1. Acceptance of Terms

By downloading, installing, or using Gigachat ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Gigachat is an AI chatbot application for iOS that provides access to multiple artificial intelligence models including, but not limited to:

  • OpenAI's ChatGPT models
  • Anthropic's Claude models
  • Google's Gemini models
  • Meta's Llama models
  • Mistral AI models

The App facilitates conversations with these AI models through a unified interface.

3. Subscription Terms

3.1 Available Subscriptions

Gigachat offers the following subscription options:

  • Weekly Subscription: Premium access for one week
  • Monthly Subscription: Premium access for one month
  • Yearly Subscription: Premium access for one year

3.2 Payment and Renewal

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings

3.3 Free Trial

If a free trial is offered, it will be clearly stated at the time of subscription. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not use the App to generate harmful, illegal, or abusive content
  • Not attempt to reverse engineer, decompile, or extract the source code of the App
  • Not share your account credentials with others
  • Not use the App in any way that could harm, disable, or impair the service
  • Comply with all applicable local, state, national, and international laws

5. AI Model Disclaimers

5.1 Content Accuracy

AI-generated responses may contain inaccuracies, errors, or outdated information. Gigachat does not guarantee the accuracy, completeness, or reliability of any AI-generated content.

5.2 No Professional Advice

The App does not provide professional advice (legal, medical, financial, or otherwise). Do not rely on AI responses for professional decisions. Always consult qualified professionals for such matters.

5.3 Third-Party AI Services

The App relies on third-party AI services (OpenAI, Anthropic, Google, Meta, Mistral). We are not responsible for the availability, accuracy, or performance of these third-party services.

6. Content Ownership and Rights

6.1 Your Content

You retain ownership of the messages and prompts you submit to the App. By using the App, you grant us a license to process your content through third-party AI services to provide the service.

6.2 AI-Generated Content

AI-generated responses are provided "as is." The ownership and usage rights of AI-generated content are subject to the terms of the underlying AI service providers.

7. Prohibited Uses

You may not use the App to:

  • Generate content that violates any law or regulation
  • Create, distribute, or store illegal content
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Collect or store personal data of others without consent
  • Attempt to gain unauthorized access to any systems or networks
  • Interfere with or disrupt the App or its servers

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The App may be unavailable due to:

  • Maintenance or updates
  • Third-party service outages
  • Technical issues beyond our control
  • Force majeure events

9. Termination

9.1 By You

You may cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period.

9.2 By Us

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in fraudulent or abusive behavior.

10. Refund Policy

All purchases are processed through the Apple App Store. Refund requests must be submitted through Apple according to their refund policies. We do not directly process refunds.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE PAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR DECISIONS MADE BASED ON AI-GENERATED CONTENT

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of AI-generated content

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where the service provider is located, without regard to conflict of law principles.
